With these general sales conditions, Bicho Style sells and the CUSTOMER purchases remotely the material shown and offered for sale on Bichostyle.it website. The contract is concluded exclusively on the Internet, through the CUSTOMER access to BichoStyle website and the execution of a purchase order according to the procedure provided by the website itself.

Before confirming their order, the customer agrees to inspect these general terms of sale, especially the pre-contractual information provided by Bicho Style and furthermore, he agrees to accept them by affixing a flag in the indicated box.

In the order confirmation e-mail, the CUSTOMER will also receive the link to download and store a copy of these general sales conditions, as provided by art. 51 paragraph 1 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

Before the conclusion of the purchase agreement, the CUSTOMER examines the goods’ characteristics shown on every single product fiche every time the CUSTOMER makes his own purchase choice.

Before the conclusion of the purchase contract and before validating the order with “payment obligation”, the CUSTOMER is informed about:

• the total price of the goods including the taxes, with the details of the shipping costs and any other costs;
• payment methods;

– the term within Bicho Style undertakes to deliver the goods;

– conditions, terms and procedures for exercising the right of withdrawal (Article 6 of these Conditions) and form

• type of withdrawal referred to in Annex I, Part B of Legislative Decree 21/2014;
• information that the CUSTOMER will have to bear the cost of returning the goods in case of withdrawal;
• the existence of a legal guarantee of conformity for the purchased goods;
• post-sales support conditions and commercial guarantees provided by Bicho Style.

The Purchase Order manifests the CUSTOMER’s will to buy the product/s indicated in the relevant order. The purchase order will be considered issued upon completion of the on-line purchase procedure in the appropriate section of the website. After entering the purchase order, the CUSTOMER will receive a confirmation e-mail and an order receipt indicating the order identifying number and the details of the product/s indicated in the order (hereinafter “Order Summary”).The “Order Summary” represents only a communication from Bicho Style to CUSTOMER that the company received the purchase order entered by the CUSTOMER and therefore the purchase order will not be accepted by Bicho Style. All orders for a product will be indeed subject to a specific acceptance by Bicho Style. The sales contract is considered concluded once Bicho Style sends to the CUSTOMER a confirmation email of the product being shipped. Bicho Style reserves the right to refuse an order in the event that:

• the product and / or the service is unavailable;

• Bicho Style does not receive authorization to charge the product Cost and / or customer service;
• the User does not meet the eligibility criteria that are: being 18 years of age, accessing the website from the national territory and not, and being a natural person who acts for non-professional purposes and purchases the product as a consumer (“CUSTOMER”);

• at the time of purchase a price obviously incorrect and recognizable as such is indicated.

By placing a purchase order on the website, the customer declares:

• To be 18 years old;
• To access the site from the national territory and not;
• To be a natural person who acts for non-professional purposes and purchases the product as a consumer.
• The email contains the CUSTOMER data and the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent and the link in order to print and store the copy of these conditions.

The CUSTOMER undertakes to verify the correctness of the personal data contained therein and to promptly notify Bicho Style of any corrections.

Bicho Style is committed to describe and show the articles sold on the website in the best possible way. Nevertheless, some errors, inaccuracies or small differences between the website and the actual product may appear. In addition, the photographs of the products shown on http://www.bichostyle.it/shop are not a contractual element, as they are only representative.

Bicho Style undertakes to deliver the goods within 30 days after sending Bicho Style’s order confirmation e-mail to the CUSTOMER

The availability of the products refers to the actual availability when the CUSTOMER places an order. However, this availability must be considered purely indicative because, due to the simultaneous presence on the website of multiple users, the products could be sold to other CUSTOMERS before order confirmation.

Also after the order confirmation e-mail sent by Bicho Style, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically adjusted by deleting the unavailable product and the CLIENT will be immediately informed by email.

If the CUSTOMER requires the cancellation of the order, by terminating the contract, Bicho Style will refund the amount paid within 14 days from the day Bicho Style has known the customer’s decision to terminate the contract.

Any payment by the CUSTOMER can only be effected by means of the credit cards indicated on the website http://www.bichostyle.it/shop, by bank transfer or by Paypal payment method.

In case of credit card payment, the actual amount of the order will be charged only when the order is complete and ready for shipment.

In case of payment with Paypal, the actual charge will be made only when Bicho Style sends the order  confirmation e-mail.

Payment communications and data provided by CUSTOMER when the payment is done takes place on special protected lines.

All sales prices of the products shown on the BichoStyle site are expressed in Euros and are inclusive of VAT.

Shipping costs are not included in the purchase price, but they are indicated and calculated at the time of the purchase process before the payment is made.

CUSTOMER accepts Bicho Style’s ability to change its prices at any time, however, the merchandise will be invoiced on the basis of prices indicated on the website at the time of order creation and indicated in the confirmation email sent by Bicho Style to CUSTOMER.

In case of computer, manual, technical error or any other error that may cause a substantial change, unexpected by Bicho Style, of the sale price to the public, which makes it exorbitant or clearly derisory the purchase order will be considered invalid and canceled and the amount paid by the CUSTOMER will be refunded within 14 days from the day of cancellation.

In accordance with the art.52 D.lgs. 206/2005 (“Consumption Code”), the CUSTOMER may terminate the Contract within 14 days from the date of delivery of the Product. In order to comply with the term of withdrawal, it is sufficient that the CUSTOMER before the expiration of the withdrawal period follows the planned process.

The CUSTOMER will have to take all appropriate measures to preserve the product and do everything possible.

The CUSTOMER who will to exercise the right of withdrawal must notify Bicho Style through an explicit statement, which can be transmitted by registered mail or by visiting “My Orders” section on the space “My account Bicho Syle” on the BichoStyle website, with the creation of a online withdrawal file, or by contacting customer service at the phone number 0664508785.

The CUSTOMER is responsible for the integrity of the product as long as the good is in his possession.

In the event of exercise of the right of withdrawal, the CUSTOMER is required to return the goods within 14 days of the day on which he informed Bicho Style of his intention to withdraw from the contract pursuant to art. 57 of Legislative Decree 206/2005.

The goods will be returned to Bicho Style by Capponi Deborah Maria Luisa, at Via Fioravante Martinelli 56 / a- 00156 Rome (RM).

In the event of a withdrawal with the return of the product at the point of sale, there is no need to create a online withdrawal file.

The direct costs of returning products are charged to the CUSTOMER.

The goods must be returned intact, in the original packaging, complete in all parts (including packaging and any documentation and ancillary equipment) and with the attached tax documentation. Subject to the ability to verify compliance with the foregoing, Bicho Style will refund the amount of products returned within a maximum of 14 days, including any shipping costs.

As foreseen by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by D.lgs 21/2014, Bicho Style may suspend the repayment until the receipt of the goods or until the CUSTOMER demonstrates that he has returned the goods to Bicho Style.

Bicho Style will make a refund using the same payment method chosen by the CUSTOMER when purchasing. In the case of payment by wire transfer, and if the CUSTOMER intends to exercise its right of withdrawal, he will have to provide Bicho Style, by accessing the contact section, the bank coordinates: IBAN, SWIFT and BIC required for the repayment by Bicho Style.

In the event of receipt of goods that are not in conformity with the order or defective, the CUSTOMER is entitled to restoration of product’s conformity with no expenses by repairing or replacing of the product. Bicho Style, in the case of a defective or non-conforming product, will arrange the withdrawal of the product, at its own expense, in accordance with the CUSTOMER’s availability.

All the products shown on the BichoStyle website have, in addition to the legal compliance guarantee referred to in the previous article, a commercial guarantee, the duration of which is cited in the product data sheets.

In order to benefit from warranty service, the CUSTOMER will have to keep the invoice which can be printed by accessing the “My Orders” section on the “My Bicho Style Account” space.

Bicho Style will accept purchase orders made outside the Italian national territory, that require the shipment of the products outside the Italian national territory.

The products will be delivered by Bicho Style as follows:

• Standard shipping Italy, which includes delivery within 2-3 business days at a cost of EURO 5.99;
• Foreign shipping, with delivery according to the destination, at a cost of Euro 11.99

Bicho Style guarantees delivery within 2 business days for orders from Monday to Friday before 4.00pm. Working days are from Monday to Friday. For Basilicata, Campania, Calabria, Apulia and Islands delivery may take an additional day.

Shipment costs may be modified by Bicho Style, provided that any changes do not in any way affect the contracts already concluded before the change.

The CUSTOMER when purchasing the product has the right to choose the type of shipment that will then be specified in the Shipment Confirmation e-mail.

The CUSTOMER will receive IN THE EMAIL of Shipment Confirmation the shipment tracking number and will be able to check the status of shipment of the purchased product. Upon delivery of the product, it will be necessary the presence of the CUSTOMER or a third part authorised to pick up the product by signing the relevant shipping document. If the product has not been delivered within the terms indicated in the Shipping Confirmation email, the CLIENT can contact Bicho Style according to the terms on the BichoStyle site or by telephone at 0664508785.

For each order made on the website, Bicho Style issues an invoice of the shipped product.

The invoice is available and printable, after the order is delivered, in “My Orders” section of the CUSTOMER “My Account Bicho Style” section.The invoice will contain the information provided by the CUSTOMER during the purchase procedure. After the invoice is issued, you will not be able to make any changes to the data shown in the invoice.

Bicho Style assumes no liability for any disavowal due to force majeure or fortuitous accident, even if it is affected by malfunctions and disadvantages of the Internet, if it fails to execute the order within the terms of the contract.

Force majeure events include, but are not limited to, the following circumstances:

Strikes, locks and other industrial disputes;

Civil mobilizations and insurrections, invasions, terrorist attacks or threats of terrorist attacks, armed conflicts (whether declared or not) or threats or conflict preparation;

Fires, explosions, storms, floods, earthquakes, epidemics or other natural disasters;

impossibility to use public or private telecommunications means;

pandemics or epidemics.

Bicho Style’s performance of the obligations under these General Terms and Conditions shall be deemed to be suspended for the period when Major Forces Events occur. Bicho Style will perform any act in its power in order to find solutions that will enable the proper fulfillment of its obligations despite the persistence of Major Force Events.

The CUSTOMER has the right to access the website for consultation and purchase. No other use, in particular commercial, of the website or its contents, is permitted. The integrity of this website, whether sound or visual, and the related technology remain property of Bicho Style and are protected by intellectual property law.

The BichoStyle website uses “cookies”. Cookies are electronic files that store information about CUSTOMER’s browsing on the site (consulted pages, date and time of consultation, etc.) and allow Bicho Style to offer a customized service to its customers.

Bicho Style informs the customer of the possibility of deactivating the creation of such files by accessing their Internet configuration menu. It is understood that this will prevent the Customer from proceeding to online purchase.

These General Terms and Conditions of Sale are made up of all the clauses that form them. If one or more of the provisions of these General Terms and Conditions of Sale are considered invalid or declared in accordance with the law, regulation or decision of a court having jurisdiction, the other provisions will continue to be fully effective.

Failure to comply with any of the provisions of these General Conditions will not affect the right of each party to claim fulfillment at any time thereafter, or to waive the exercise of a right arising out of a breach of these General Conditions will constitute a waiver of the exercise of a right arising from a subsequent violation of the same provision.

No waiver by either party to an article of these General Conditions will be effective unless expressly stated to be a waiver and is communicated in writing.

If any provision of these General Terms is unlawful or invalid, it will not come considered as part of the General Terms and this will not affect the remaining provisions that will continue to be valid to the maximum extent permitted by law.
